Welcome to JustMediationHub, a digital platform owned and operated by JustMediationHub Inc., a corporation registered in the Province of Quebec, Canada (“JustMediationHub,” “we,” “our,” or “us”).

These Terms of Use (“Terms”) form a legally binding agreement between you (“you,” “User,” “Mediator,” “Arbitrator,” or “Client”) and JustMediationHub regarding your access to and use of:

  • the JustMediationHub website
  • the JustMediationHub application
  • all related services, features, and content

FBy using the Site or Services, you agree to be bound by these Terms. If you do not agree, you must discontinue use immediately.

1. ACCEPTANCE OF TERMS

By accessing or using JustMediationHub, you acknowledge that:

  • You have read and understand these Terms.
  • You agree to comply with all applicable Canadian, Quebec, and international laws.
  • You are at least 18 years old.
  • All information you provide is accurate and truthful.

We may update these Terms from time to time. Changes take effect when posted on the Site. Continued use indicates acceptance.

2. ELIGIBILITY

You may use the Site only if you:

  • are legally able to enter into a binding contract,
  • are not suspended or prohibited from using the platform,
  • comply with all professional, regulatory, mediation, and arbitration standards applicable in your jurisdiction.

Mediators and Arbitrators must comply with their licensing and ethical obligations.

3. USER ACCOUNTS & REGISTRATION

To access certain features, you must register an account. You agree to:

  • keep your login information confidential,
  • notify us immediately of any unauthorized use,
  • maintain accurate and current information.

We may suspend or terminate accounts for false information or misuse.

4. FEES & PAYMENTS

Fees for platform access, subscription packages, or service tools will be displayed at checkout.

We accept the following payment methods:

  • Visa
  • Mastercard
  • American Express
  • Discover
  • Any other methods made available at checkout

All prices are in Canadian dollars (CAD) unless otherwise specified.

Payments are non-refundable except where required by Canadian consumer protection laws.

5. PROFESSIONAL RESPONSIBILITY

JustMediationHub is a technology platform. It does not:

  • practice law,
  • provide legal advice,
  • guarantee mediator competency,
  • supervise mediators or arbitrators.

All services between Users and Mediators are solely between those parties.

JustMediationHub is not liable for any advice, outcome, or communication between the parties.

6. PROHIBITED ACTIVITIES

Users agree not to:

  • misuse the Site or Services
  • impersonate another person
  • collect data unlawfully
  • defraud, harass, or abuse other Users
  • upload viruses or malicious code
  • interfere with system security
  • use automated bots or scraping tools
  • violate intellectual property rights
  • engage in hate speech, discrimination, or illegal activity

Violation may result in account suspension or legal action.

7. INTELLECTUAL PROPERTY

Users may upload documents, resumes, and communications for verification or profile building.

All content, trademarks, branding, code, graphics, videos, and text on JustMediationHub are the exclusive property of JustMediationHub Inc.

You may not copy, reproduce, reverse-engineer, or exploit platform content without written permission.

8. USER-GENERATED CONTENT

Users may upload documents, resumes, and communications for verification or profile building.

You retain ownership of your content, but grant us a limited licence to display and store it solely to operate the platform.

You confirm that:

  • you have rights to the materials you upload
  • your content does not violate privacy or copyright laws
  • your content is professional, accurate, and appropriate

9. PRIVACY & DATA HANDLING

We comply with:

  • PIPEDA (Personal Information Protection and Electronic Documents Act)
  • Quebec’s Law 25 (formerly Bill 64)
  • Applicable Canadian privacy regulations

Our Privacy Policy explains how we collect, use, store, and protect your information.

10. COPYRIGHT NOTICE (CANADIAN FRAMEWORK)

If you believe content on the platform infringes your copyright, send a written notice to our Designated Copyright Agent:

  • Your contact information
  • Identification of the copyrighted work
  • Description of the infringing material
  • Proof of ownership
  • A statement of good-faith belief
  • A statement of accuracy made under penalty of perjury
  • Your signature

We follow Canadian copyright law, not U.S. DMCA.

11. TERMINATION

We may suspend or terminate access:

  • for violations of these Terms,
  • to protect the platform,
  • to comply with law,
  • or at our discretion.

You may delete your account at any time. Some information may remain for regulatory or security compliance.

12. LIMITATION OF LIABILITY (CANADIAN COMPLIANT)

To the fullest extent permitted by Canadian law, JustMediationHub is not liable for:

  • loss of data, profits, or revenue,
  • professional errors made by mediators,
  • user disputes,
  • platform downtime or interruptions,
  • indirect or consequential damages.

If liability cannot be excluded, it is limited to the greater of:

  • CAD $100, or
  • the amount you paid in the previous 6 months.

13. GOVERNING LAW & DISPUTE RESOLUTION

These Terms are governed by the laws of:

The Province of Quebec, Canada

Any disputes must be resolved:

  • First by informal negotiation
  • If unresolved, by mediation in Quebec
  • If still unresolved, by binding arbitration under Quebec civil law
  • Court proceedings may occur only where arbitration is prohibited by law

Users waive class-action rights except where prohibited under Quebec consumer law.

14. MISCELLANEOUS

  • These Terms constitute the entire agreement between you and JustMediationHub.
  • If any provision is invalid, the remainder remains in effect.
  • No waiver is implied by non-enforcement.
  • We may assign our rights to affiliates or successors.
